Terms of Service

Important: By completing a purchase you confirm that you have read, understood, and agree to these Terms of Service in full.
1. Overview
These Terms of Service ("Agreement") govern the purchase and use of web design and hosting services provided by BlueBloom Digital trading as 24HourWebsite.com ("we", "us", "our"). By placing an order or using our services, you ("Client") agree to these terms in full, without modification.
This Agreement is governed by the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act 68 of 2008 (CPA), the Copyright Act 98 of 1978, and the Protection of Personal Information Act 4 of 2013 (POPIA). International clients are also subject to these terms.
2. Nature of Service
Our services constitute a managed website service — not a sale of software, code, or digital goods. You are purchasing access to a professionally designed, hosted, and maintained website delivered as a service on our infrastructure.
The "24-hour delivery" countdown begins only when you submit your completed onboarding questionnaire after payment — not at the point of payment. Delivery may be affected by the completeness and timeliness of content you provide.
3. Intellectual Property & Code Ownership
All code, source files, templates, design assets, and website infrastructure remain the exclusive intellectual property of BlueBloom Digital at all times.
- The Client is granted a non-exclusive, non-transferable licence to use the delivered website for as long as their hosting account remains active and in good standing.
- No source code, database files, codebase, hosting credentials, or technical assets will be transferred to the Client, under any circumstances, including upon cancellation or project completion.
- The Client acknowledges that they are purchasing a service licence, not purchasing or commissioning software to be handed over.
- BlueBloom Digital retains the right to display the completed project in its portfolio and marketing materials, unless the Client requests otherwise in writing within 14 days of delivery.
This clause is consistent with and enforceable under the Copyright Act 98 of 1978 (South Africa) and the international Berne Convention (applicable in 181 countries).
4. Hosting & Service Continuity
- The Client's website is hosted exclusively on BlueBloom Digital's infrastructure. We do not provide migration assistance or transfer hosting to third-party providers.
- Should the Client cancel their services or fail to maintain payment, the website will be taken offline within 30 days of cancellation or non-payment.
- We are not liable for any business loss, reputational damage, or data loss arising from a service cancellation initiated by either party.
5. Payments
- All payments are processed securely by Stripe.
- Prices are listed in USD or ZAR depending on your region.
- The Monthly Care Plan is a recurring subscription billed monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period.
- One-time packages are non-refundable after project delivery, unless you are covered by our satisfaction guarantee (see Section 6).
6. Satisfaction Guarantee & Refunds
If you are genuinely unsatisfied with the delivered website after your included revision round, we will issue a full refund. Refund requests must be submitted within 7 days of final delivery. We reserve the right to refuse a refund if the request is deemed unreasonable or if the policy is being abused.
Refund requests must be sent to hello@24hourwebsite.com with your order number and a description of the issue.
7. Revisions
Each package includes one round of revisions, which must be requested within 48 hours of project delivery. Revision requests outside this window, or requests for additional revision rounds, may be subject to additional fees.
8. Client Responsibilities
- You are responsible for providing accurate business information, logos, and content.
- You confirm that any content you provide does not infringe upon the intellectual property rights of any third party.
- You are responsible for the accuracy, legality, and appropriateness of your website content once delivered.
- You agree not to use our services for any unlawful, harmful, or offensive purpose.
9. Care Plan — Monthly Subscription
- The Monthly Care Plan includes hosting, security updates, minor content changes (up to 1 hour per month), and priority support.
- "Minor content changes" means text updates, image swaps, and small layout adjustments. New pages, features, or redesigns are not included and will be quoted separately.
- The Care Plan subscription must remain active for the website to remain live and hosted on our infrastructure.
10. Limitation of Liability
BlueBloom Digital's total liability to the Client under this Agreement is limited to the total amount paid by the Client for the relevant service. We are not liable for any indirect, incidental, special, or consequential damages, including loss of revenue, loss of data, or loss of business opportunity.
11. Privacy & Data Protection
Personal information collected is processed in accordance with the Protection of Personal Information Act (POPIA) 4 of 2013 (South Africa) and, where applicable, the EU General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for full details.
12. Governing Law & Disputes
This Agreement is governed by the laws of the Republic of South Africa. Any disputes arising from this Agreement shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to the jurisdiction of the South African courts.
For international clients, disputes may be resolved through binding online arbitration in accordance with internationally recognised arbitration rules, at BlueBloom Digital's election.
13. Changes to These Terms
We reserve the right to update these Terms of Service. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We will notify active clients of material changes by email.
